Welcome to Mrs. Mellott's Educational Platform ("Chelsea"), operated by Chelsea Mellott, Special Education Teacher at Marce Herz Middle School, Washoe County School District, Reno, NV. By accessing or using our platform, you agree to be bound by these Terms of Service. This platform is designed to support special education teaching, learning, and classroom management.

2.1 Account Types

• Teacher/Admin Accounts: Full access to administrative features, student management, and content creation.
• Student Accounts: Simplified login (PIN or picture-based) with age-appropriate access to learning activities.
• Parent Accounts: View-only access to their child's progress and assignments.
• Seller Accounts: Access to marketplace features for selling educational resources.

2.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Teachers are responsible for managing student accounts in compliance with applicable privacy laws including FERPA and COPPA.

You agree to use the platform only for lawful educational purposes. You may not:

• Upload harmful, offensive, or inappropriate content
• Attempt to access accounts or data of other users
• Use the platform for commercial purposes unrelated to education
• Violate any applicable laws or regulations
• Share student information with unauthorized parties
• Reverse engineer or attempt to extract source code

4. Educational Content & IEP Data

The platform includes tools for managing Individualized Education Programs (IEPs) and student progress data. By using these features:

• You acknowledge that IEP data is sensitive and protected under IDEA and FERPA
• You agree to use IEP tools only for their intended educational purpose
• You will not share IEP data except as required by law or with proper consent
• You understand that we are not a replacement for official IEP management systems required by your district

5. Marketplace Terms

5.1 For Sellers

• You must own or have rights to all content you sell
• You are responsible for accurate product descriptions
• Commission rates and payout terms are outlined in your seller agreement
• We reserve the right to remove content that violates our policies

5.2 For Buyers

• Digital products are for personal/classroom use unless otherwise stated
• Refund policies are set by individual sellers within platform guidelines
• You may not redistribute purchased content

6. Intellectual Property

The platform, including its design, code, and default content, is owned by Chelsea Mellott / Mrs. Mellott's Educational Platform. Users retain ownership of content they create but grant us a license to display and distribute it as necessary for platform operation.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

• Uninterrupted or error-free service
• That educational content will meet specific learning outcomes
• Compliance with specific state or district IEP requirements
• Accuracy of third-party marketplace content

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

9. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may terminate your account at any time. Upon termination, you may request export of your data in accordance with our data retention policies.

10. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of material changes via email or platform notification.
