Educational Privacy Compliance

This platform is designed to comply with FERPA (Family Educational Rights and Privacy Act), COPPA (Children's Online Privacy Protection Act), and applicable state student privacy laws.

1. Information We Collect

1.1 Teacher/Admin Information

  • Name and email address for account creation
  • School/organization affiliation
  • Payment information for marketplace transactions
  • Content you create (lesson plans, activities, IEP data)

1.2 Student Information

  • Name and grade level
  • Avatar/profile picture (optional)
  • Learning activity data and progress
  • IEP goals, objectives, and progress data (if used)
  • Accessibility settings and accommodations

Note: We do not collect email addresses or personal contact information directly from students. Student accounts are created and managed by teachers.

1.3 Automatically Collected Information

  • Device type and browser information
  • Usage patterns and feature interactions
  • Error logs for troubleshooting

2. How We Use Information

  • Educational Purposes: Delivering personalized learning experiences and tracking progress
  • IEP Management: Storing and tracking IEP goals, services, and progress data
  • Platform Operation: Maintaining and improving the platform
  • Communication: Sending account-related notifications
  • Marketplace: Processing purchases and payments
  • Analytics: Understanding usage patterns to improve features

We never: Sell student data, use student data for advertising, or share student data with third parties except as required to operate the platform or comply with legal obligations.

3. Information Sharing

We share information only in these circumstances:

  • With Teachers: Student progress data is visible to their assigned teachers
  • With Parents: If parent access is enabled, parents can view their child's progress
  • Service Providers: Hosting, payment processing, and other essential services
  • Legal Requirements: When required by law or to protect safety
  • With Consent: When you explicitly authorize sharing

4. Data Security

We implement security measures including:

  • Encryption in transit (HTTPS/TLS) and at rest
  • Secure authentication with password hashing
  • Role-based access controls
  • Regular security assessments
  • Secure data backup procedures

Student login options (PIN or picture-based) are designed to be age-appropriate while maintaining reasonable security for educational settings.

5. Children's Privacy (COPPA)

We are committed to protecting children's privacy. For students under 13:

  • Teachers act as agents for parental consent under COPPA school exception
  • We collect only information necessary for educational purposes
  • We do not condition participation on disclosure of more information than necessary
  • Parents/guardians may request access to or deletion of their child's data
  • We do not display advertising to students

6. Your Rights

You have the right to:

  • Access: Request a copy of your data
  • Correction: Update inaccurate information
  • Deletion: Request deletion of your data
  • Export: Receive your data in a portable format
  • Restrict Processing: Limit how we use your data

Teachers can manage student data through the admin interface. For other requests, please contact us using the information below.

7. Data Retention

  • Active Accounts: Data retained while account is active
  • Student Data: Retained for the school year plus additional period for record-keeping
  • IEP Data: Retained according to IDEA record retention requirements
  • Deleted Accounts: Data removed within 30 days of deletion request

8. Third-Party Services

We use the following third-party services:

  • Hosting: Cloud hosting providers with SOC 2 compliance
  • Payments: Stripe and PayPal for marketplace transactions
  • Analytics: Privacy-respecting analytics (no student data)

All third-party services are vetted for educational privacy compliance and bound by data processing agreements.

9. Policy Updates

We may update this policy periodically. Material changes will be communicated via email and/or platform notification. Continued use after changes constitutes acceptance.
